INTERNET STORE TERMS OF SERVICE (OFFER AGREEMENT)
INDIVIDUAL ENTREPRENEUR ELINA SERGEEVNA ISMUNTS, operating the internet store at https://jammalun.ru/ (hereinafter referred to as the "SELLER"), publishes this agreement, which is a public offer agreement addressed to both individuals and legal entities (hereinafter referred to as the "BUYER"), as follows:
1. Subject of the Offer Agreement.
1.1. The SELLER undertakes to transfer ownership of the goods ordered in the internet store https://jammalun.ru/ (hereinafter "GOODS") to the BUYER, and the BUYER undertakes to pay for and accept the said GOODS.
2. Moment of Agreement Conclusion.
2.1. The text of this Agreement is a public offer (in accordance with Article 435 and Part 2 of Article 437 of the Civil Code of the Russian Federation).
2.2. The act of placing an ORDER for GOODS with the SELLER, either independently or through an operator, constitutes unconditional acceptance of this Agreement, and the BUYER is considered to have entered into a contractual relationship with INDIVIDUAL ENTREPRENEUR ELINA SERGEEVNA ISMUNTS.
2.3. The ORDER for GOODS and checkout are processed by the BUYER placing an order in the internet store at https://jammalun.ru/.
3. Price of GOODS.
3.1. Prices in the internet store are indicated in the currency of the buyer's country per unit of GOODS.
4. Payment for GOODS.
4.1. For cash payments, the BUYER is obliged to pay the SELLER the price of the GOODS at the moment of its transfer, and the SELLER is obliged to provide the BUYER with a cash or sales receipt, or other document confirming payment for the GOODS.
4.2. For non-cash payments, the BUYER's obligation to pay the price of the GOODS is considered fulfilled from the moment funds are debited in the amount of 100% (one hundred percent) advance payment from the BUYER's bank account, or from an account with a credit institution providing payment services to individuals in accordance with the current legislation of the Russian Federation, including using electronic money.
4.3. For non-cash payments, a delay in payment by the BUYER of the GOODS price for more than 3 (three) days constitutes a material breach of this agreement. In this case, the SELLER has the right to unilaterally refuse to perform this agreement, notifying the BUYER accordingly.
4.4. GOODS are supplied to the BUYER at the prices, names, and quantities corresponding to the invoice paid by the BUYER.
5. Delivery of GOODS.
5.1. Delivery of GOODS to the BUYER is carried out to the address and within the timeframes agreed upon by the BUYER and the SELLER's manager when placing the ORDER.
5.2. The exact cost of delivery of the GOODS is determined by the SELLER's manager when placing the order and cannot be changed after confirmation by the BUYER.
5.3. The BUYER's failure to appear or failure to perform other necessary actions to accept the GOODS may be considered by the SELLER as the BUYER's refusal to perform the AGREEMENT.
6. Rights and Obligations of the Parties.
6.1. The SELLER undertakes to:
6.1.1. Provide the BUYER, prior to concluding the agreement, with information about the main consumer properties of the GOODS, the SELLER's address (location), place of manufacture of the GOODS, the SELLER's full corporate name (name), price and terms of purchase of the GOODS, its delivery, service life, shelf life, payment procedure, as well as the period for which the offer to conclude the Agreement is valid.
6.1.2. Not disclose any private information of the BUYER and not provide access to this information to third parties, except as provided by Russian law.
6.1.3. Provide the BUYER with the opportunity to receive free telephone consultations at the numbers specified on the store's website (https://jammalun.ru/). The scope of consultations is limited to specific issues related to the execution of the ORDER.
6.1.4. The SELLER reserves the right to amend this AGREEMENT unilaterally until the moment of its conclusion.
6.1.5. Provide the Consumer at the moment of delivery of the goods with written information about the product, as provided for by Article 10 of the Federal Law "On Protection of Consumer Rights," as well as the information provided for in clause 10 of this Agreement regarding the procedure and terms for returning the goods.
6.2. The BUYER undertakes to:
6.2.1. Familiarize themselves with the content of the offer agreement, payment, and delivery terms on the store's website (https://jammalun.ru/) prior to concluding the AGREEMENT.
6.2.2. Provide accurate information about themselves (Full Name, contact phone numbers, email address) and details for the delivery of the GOODS.
6.2.3. Accept and pay for the GOODS within the timeframes specified in this AGREEMENT.
7. Liability of the Parties and Dispute Resolution.
7.1. The Parties shall be liable for failure to perform or improper performance of this AGREEMENT in the manner prescribed by this AGREEMENT and the current legislation of the Russian Federation.
7.2. The Seller is not responsible for the delivery of the ORDER if the BUYER provided an incorrect delivery address.
7.3. The SELLER is not responsible if the BUYER's expectations regarding the consumer properties of the GOODS were not met.
7.4. The SELLER is not liable for partial or complete failure to fulfill obligations for the delivery of the GOODS if such failure is a consequence of force majeure circumstances.
7.5. By placing an ORDER, the BUYER is responsible for the accuracy of the information provided about themselves and confirms that they have read and agree to the terms of this AGREEMENT.
7.6. All disputes and disagreements arising during the performance of obligations under this Agreement by the PARTIES shall be resolved through negotiations. If it is impossible to resolve them, the PARTIES have the right to seek judicial protection of their interests.
8. Return and Exchange of Goods.
8.1. The BUYER's request for exchange or return of the GOODS shall be satisfied if the GOODS has not been used, its consumer properties are preserved, the packaging is preserved and undamaged, and the documents confirming the fact of purchase of this GOODS in the internet store https://jammalun.ru/ are preserved.
8.2. GOODS made to order cannot be returned or exchanged.
8.3. The period for making such a request is 14 (fourteen) days from the date of transfer of the GOODS to the BUYER, or at any time before the transfer of the GOODS to the BUYER.
8.4. The BUYER shall compensate the SELLER for the necessary transportation expenses incurred in connection with the organization of the exchange or return of the GOODS.
9. Force Majeure Circumstances.
9.1. The Parties shall be released from liability for failure to perform or improper performance of obligations under the Agreement for the duration of force majeure. Force majeure means extraordinary and unavoidable circumstances under the given conditions that prevent the PARTIES from fulfilling their obligations under this Agreement. These include natural phenomena (earthquakes, floods, etc.), public life circumstances (military actions, state of emergency, major strikes, epidemics, etc.), prohibitive measures by state authorities (transport bans, currency restrictions, international trade sanctions, etc.). During this time, the PARTIES have no mutual claims, and each Party bears its own risk of the consequences of force majeure circumstances.
10. Term of the Agreement.
10.1. This AGREEMENT comes into force from the moment of contacting INDIVIDUAL ENTREPRENEUR ELINA SERGEEVNA ISMUNTS and placing an ORDER and terminates upon the full performance of obligations by the PARTIES.
11. Personal Data.
11.1. The SELLER collects and processes the BUYERS' personal data (namely: the BUYER's last name, first name, patronymic; delivery address; contact phone number) for the purposes of:
* Fulfilling the terms of this Agreement;
* Delivering the ordered Goods to the Buyer.
11.2. By placing an ORDER for GOODS in the internet store https://jammalun.ru/, the BUYER gives consent to the collection and processing of their personal data for the purpose of delivering the ordered GOODS and fulfilling the terms of this AGREEMENT.
11.3. When collecting and processing the BUYERS' personal data, the SELLER pursues no other purposes than those established in clause 11.1 of this AGREEMENT.
11.4. Only persons directly related to the fulfillment of ORDERS have access to the BUYERS' personal data.
